Information about the processing of personal data on Airbuy.
Privacy policy
We are delighted by your interest in our company. Data protection is of paramount importance to the management of Liquidinterface Pierre Kunz. Use of the Liquidinterface Pierre Kunz website is generally possible without providing any personal data. However, if a data subject wishes to use special services offered by our company via our website, processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the data subject's consent.
The processing of personal data, such as the name, address, email address, or telephone number of a data subject, is always carried out in accordance with the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to Liquidinterface Pierre Kunz. This privacy policy aims to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, this privacy policy informs data subjects about their rights.
Liquidinterface Pierre Kunz, as the data controller, has implemented numerous technical and organizational measures to ensure the most complete possible protection of personal data processed via this website. However, internet-based data transmissions can fundamentally have security vulnerabilities, meaning absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us via alternative means, such as by telephone.
1. Name and address of the data controller
The controller within the meaning of the General Data Protection Regulation, other data protection laws applicable in the Member States of the European Union and other provisions of a data protection nature is:
Schillerhöffe – Holländer Strasse 90-106 13407 Berlin
2. Cookies
The Liquidinterface Pierre Kunz website uses cookies. Cookies are text files that are placed and stored on a computer system via an internet browser.
Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited websites and servers to distinguish the individual browser of the data subject from other internet browsers that contain other cookies. A specific Internet browser can be recognized and identified via the unique cookie ID.
Through the use of cookies, Liquidinterface Pierre Kunz can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.
Using a cookie, the information and offers on our website can be optimized for the benefit of the user. As already mentioned, cookies enable us to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website because this is done by the website and the cookie stored on the user's computer system.
The data subject can prevent the setting of cookies through our website at any time by means of an appropriate setting in the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time using an internet browser or other software programs. This is possible in all common internet browsers. If the person concerned deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.
3. Collection of general data and information
The Liquidinterface Pierre Kunz website collects a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server’s log files. What can be recorded are the (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing person Systems and (8) other similar data and information that serve to avert danger in the event of attacks on our information technology systems.
When using these general data and information, Liquidinterface Pierre Kunz does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website and (4) to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. These anonymously collected data and information are evaluated by Liquidinterface Pierre Kunz both statistically and with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data provided by a data subject.
4. Subscription to our newsletter
On the Liquidinterface Pierre Kunz website, users are given the opportunity to subscribe to our company's newsletter. Which personal data is transmitted to the person responsible for processing when ordering the newsletter is determined by the input mask used for this purpose.
Liquidinterface Pierre Kunz regularly informs its customers and business partners about company offers by means of a newsletter. In principle, our company's newsletter can only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers to receive the newsletter. For legal reasons, a confirmation email will be sent using the double opt-in procedure to the email address entered by a data subject for the first time to receive the newsletter. This confirmation email is used to check whether the owner of the email address as the data subject has authorized receipt of the newsletter.
When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration as well as the date and time of registration. The collection of this data is necessary in order to be able to understand the (possible) misuse of the email address of a data subject at a later point in time and therefore serves to provide legal protection for the person responsible for processing.
The personal data collected when registering for the newsletter is used exclusively to send our newsletter. Furthermore, subscribers to the newsletter could be informed by email if this is necessary for the operation of the newsletter service or a related registration, as could be the case in the event of changes to the newsletter offer or a change in technical circumstances. The personal data collected as part of the newsletter service will not be passed on to third parties. The data subject can cancel the subscription to our newsletter at any time. The consent to the storage of personal data that the data subject has given us for sending the newsletter can be revoked at any time. For the purpose of revoking your consent, there is a corresponding link in every newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller or to communicate this to the controller in another way.
5. Newsletter tracking
The Liquidinterface Pierre Kunz newsletter contains so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in emails sent in HTML format to enable log file recording and log file analysis. This allows a statistical analysis of the success or failure of online marketing campaigns to be carried out. Based on the embedded tracking pixel, Liquidinterface Pierre Kunz can see if and when an email was opened by a data subject and which links in the email were accessed by the data subject.
Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the person responsible for processing in order to optimize the sending of the newsletter and to adapt the content of future newsletters even better to the interests of the data subject. This personal data will not be passed on to third parties. Affected persons are entitled at any time to revoke the relevant separate declaration of consent issued via the double opt-in procedure. After revocation, these personal data will be deleted by the person responsible for processing. If you unsubscribe from receiving the newsletter, Liquidinterface Pierre Kunz automatically interprets this as a revocation.
6. Contact option via the website
Due to legal regulations, the Liquidinterface Pierre Kunz website contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (e-mail address). If a data subject contacts the person responsible for processing by email or via a contact form, the personal data transmitted by the data subject will be automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller will be stored for the purposes of processing or contacting the data subject. This personal data will not be passed on to third parties.
7. Comment function in the blog on the website
The Liquidinterface Pierre Kunz offers users the opportunity to leave individual comments on individual blog posts on a blog, which is on the website of the controller.
If a data subject leaves a comment on the blog published on this website, in addition to the comments left by the data subject, information on the time the comment was entered and on the user name (pseudonym) chosen by the data subject will be stored and published. Furthermore, the IP address assigned to the data subject by the Internet service provider (ISP) is also logged. The IP address is stored for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through a comment made. The storage of this personal data is therefore in the own interest of the person responsible for processing, so that he could be exculpated in the event of a legal violation. This collected personal data will not be passed on to third parties unless such transfer is required by law or serves the legal defense of the person responsible for processing.
8. Using zoom for online meetings
Purpose of processing
We use the “Zoom” tool to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: “online meetings”). “Zoom” is a service of Zoom Video Communications, Inc., which is based in the USA.
Responsible person
The person responsible for data processing that is directly related to the implementation of “online meetings” is Liquidinterface Pierre Kunz.
Note: If you access the “Zoom” website, the “Zoom” provider is responsible for data processing. However, to use “Zoom”, you only need to visit the website to download the software for using “Zoom”.
You can also use “Zoom” if you enter the respective meeting ID and, if necessary, other access data for the meeting directly in the “Zoom” app.
If you do not want to or cannot use the “Zoom” app, the basic functions can also be used via a browser version, which you can also find on the “Zoom” website.
Which data is processed?
When using “Zoom” different types of data are processed. The extent of the data also depends on what data information you provide before or when participating in an “online meeting”.
The following personal data are the subject of processing:
User information: First name, last name, phone (optional), email address, password (if single sign-on is not used), profile picture (optional), department (optional)
Meeting metadata: topic, description (optional), participant IP addresses, device/hardware information
For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.
When dialing in with the telephone: information about the incoming and outgoing phone number, country name, start and end time. If necessary, additional connection data such as the IP address of the device can be saved.
Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in an “online meeting”. In this respect, the text entries you make will be processed in order to display them in the “online meeting” and, if necessary, to record them. In order to enable the display of video and the playback of audio, the data from the microphone of your device and any video camera on the device are processed for the duration of the meeting. You can switch off or mute the camera or microphone at any time using the “Zoom” applications.
In order to take part in an “online meeting” or enter the “meeting room”, you must at least provide information about your name.
Scope of processing
We use “Zoom” to conduct “online meetings”. If we want to record “online meetings”, we will inform you transparently in advance and – if necessary – ask for your consent. The fact of the recording will also be displayed to you in the “Zoom” app.
If necessary for the purposes of logging the results of an online meeting, we will log the chat content. However, this will usually not be the case.
In the case of webinars, we can also process the questions asked by webinar participants for the purposes of recording and following up on webinars.
If you are registered as a user with “Zoom”, then reports about “online meetings” (meeting metadata, telephone dial-in data, questions and answers in webinars, poll function in webinars) can be stored with “Zoom” for up to one month.
Automated decision-making within the meaning of Art. 22 GDPR is not used.
Legal basis for data processing
As far as personal data of Liquidinterface Pierre Kunz employees is processed, Section 26 BDSG is the legal basis for data processing. If, in connection with the use of “Zoom”, personal data is not necessary for the establishment, implementation or termination of the employment relationship, but is nevertheless an elementary part of the use of “Zoom”, then Art. 6 Para. 1 lit. f) GDPR is the legal basis for data processing. In these cases, our interest is in the effective implementation of “online meetings”.
Furthermore, the legal basis for data processing when conducting “online meetings” is Article 6 Paragraph 1 Letter b) GDPR, insofar as the meetings are carried out within the framework of contractual relationships.
If there is no contractual relationship, the legal basis is Article 6 Paragraph 1 Letter f) GDPR. Here, too, we are interested in the effective implementation of “online meetings”.
Recipient/transfer of data
Personal data processed in connection with participation in “online meetings” will generally not be passed on to third parties unless they are specifically intended to be passed on.
Other recipients: The provider of “Zoom” necessarily receives knowledge of the above-mentioned data, insofar as this is provided for within the scope of our order processing agreement with “Zoom”.
Data processing outside the European Union
“Zoom” is a service provided by a provider from the USA. Processing of personal data also takes place in a third country. We have concluded an order processing agreement with the provider of “Zoom” that meets the requirements of Art. 28 GDPR.
An appropriate level of data protection is guaranteed on the one hand by the “Privacy Shield” certification of Zoom Video Communications, Inc., but also by the conclusion of the so-called EU standard contractual clauses.
9. Routine deletion and blocking of personal data
The person responsible for processing processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage or if this has been provided for by the European legislator or another legislator in laws or regulations to which the person responsible for processing is subject.
If the purpose of storage no longer applies or if a storage period prescribed by the European legislator or another responsible legislator expires, the personal data will be blocked or deleted routinely and in accordance with legal regulations.
10. Rights of the data subject
a) Right to confirmation
b) Right to information
Every person affected by the processing of personal data has the right granted by the European legislator to obtain free information from the person responsible for processing at any time about the personal data stored about him and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:
The data subject also has the right to information as to whether personal data has been transmitted to a third country or to an international organization. If this is the case, the data subject also has the right to receive information about the appropriate guarantees in connection with the transfer.
c) Right to rectification
Every person affected by the processing of personal data has the right granted by the European legislator to request the immediate correction of incorrect personal data concerning them. Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary statement.
d) Right to deletion (right to be forgotten)
Every person affected by the processing of personal data has the right granted by the European legislator to request that the person responsible delete the personal data concerning him or her immediately if one of the following reasons applies and if the processing is not necessary:
If one of the reasons mentioned above applies and a data subject wishes to have personal data stored at Liquidinterface Pierre Kunz deleted, they can contact an employee of the data controller at any time. The Liquidinterface employee Pierre Kunz will ensure that the deletion request is complied with immediately.
e) Right to restriction of processing
Every person affected by the processing of personal data has the right granted by the European legislator to request that the controller restrict the processing if one of the following conditions is met:
f) Right to data portability
Every person affected by the processing of personal data has the right granted by the European legislator to receive the personal data concerning him or her, which the data subject has provided to a person responsible, in a structured, common and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent in accordance with Article 6 (1) (a) GDPR or Article 9 (2) (a) GDPR or on a contract in accordance with Article 6 (1) (b) GDPR and the processing is carried out using automated procedures, provided that the processing is not necessary for the performance of a task that is in the public interest or is carried out in the exercise of official authority vested in the person responsible.
Furthermore, when exercising his or her right to data portability in accordance with Article 20 (1) of the GDPR, the data subject has the right to have the personal data transmitted directly from one person responsible to another person responsible, to the extent that this is technically feasible and provided that this does not adversely affect the rights and freedoms of other persons.
g) Right to object
Every person affected by the processing of personal data has the right granted by the European legislator to object at any time, for reasons arising from their particular situation, to the processing of personal data concerning them, which is carried out on the basis of Article 6 Paragraph 1 Letters e or f GDPR. This also applies to profiling based on these provisions.
Liquidinterface Pierre Kunz will no longer process the personal data in the event of an objection, unless we can demonstrate compelling legitimate reasons for the processing that outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.
If Liquidinterface Pierre Kunz processes personal data in order to conduct direct advertising, the data subject has the right to object at any time to the processing of personal data for the purpose of such advertising. This also applies to profiling insofar as it is connected to such direct advertising. If the data subject objects to Liquidinterface Pierre Kunz processing for direct advertising purposes, Liquidinterface Pierre Kunz will no longer process the personal data for these purposes.
In addition, the data subject has the right, for reasons arising from his or her particular situation, to object to the processing of personal data concerning him or her by Liquidinterface Pierre Kunz for scientific or historical research purposes or for statistical purposes in accordance with Article 89 (1) of the GDPR, unless such processing is necessary to fulfill a task carried out in the public interest.
h) Automated decisions in individual cases including profiling
Every person affected by the processing of personal data has the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him, provided that the decision (1) is not necessary for entering into or the performance of a contract between the data subject and the controller, or (2) is permitted by Union or Member State law to which the controller is subject and such legislation appropriates measures to safeguard the rights and freedoms as well as the legitimate interests of the data subject or (3) is carried out with the express consent of the data subject.
If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject's explicit consent, the Liquidinterface Pierre Kunz shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.
i) Right to revoke consent under data protection law
Every person affected by the processing of personal data has the right granted by the European legislator to revoke consent to the processing of personal data at any time.
11. Data protection for applications and the application process
The person responsible for processing collects and processes the personal data of applicants for the purpose of processing the application process. Processing can also take place electronically. This is particularly the case if an applicant sends relevant application documents to the person responsible for processing electronically, for example by email or via a web form on the website. If the person responsible for processing concludes an employment contract with an applicant, the data transmitted will be stored for the purpose of processing the employment relationship in compliance with legal regulations. If the person responsible for processing does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after the rejection decision is announced, provided that deletion does not conflict with any other legitimate interests of the person responsible for processing. Other legitimate interests in this sense include, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).
12. Data protection regulations regarding the application and use of Facebook
The person responsible for processing has integrated components of the company Facebook on this website. Facebook is a social network.
Facebook's operating company is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject lives outside the USA or Canada, the person responsible for processing personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
Each time you access one of the individual pages of this website, which is operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the data subject's information technology system is automatically prompted by the respective Facebook component to download a display of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be accessed at https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook becomes aware of which specific subpage of our website is visited by the data subject.
If the data subject is logged in to Facebook at the same time, Facebook recognizes which specific subpage of our website the data subject is visiting each time the data subject visits our website and for the entire duration of their stay on our website. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject clicks on one of the Facebook buttons integrated on our website, such as the “Like” button, or if the data subject makes a comment, Facebook assigns this information to the data subject’s personal Facebook user account and stores this personal data.
Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is logged in to Facebook at the same time as accessing our website; This takes place regardless of whether the data subject clicks on the Facebook component or not. If the data subject does not want this information to be transmitted to Facebook in this way, they can prevent the transmission by logging out of their Facebook account before accessing our website.
The data policy published by Facebook, which is available at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing and use of personal data by Facebook. It also explains what setting options Facebook offers to protect the privacy of the person concerned. There are also various applications available that make it possible to suppress data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.
13. Data protection regulations on the application and use of Google Analytics (with anonymization function)
The person responsible for processing has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, collection and evaluation of data about the behavior of visitors to websites. A web analysis service collects, among other things, data about the website from which a data subject came to a website (so-called referrer), which sub-pages of the website were accessed or how often and for what duration a sub-page was viewed. Web analysis is primarily used to optimize a website and to analyze the cost-benefit of internet advertising.
The operating company of the Google Analytics component is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.
The person responsible for processing uses the addition “_gat._anonymizeIp” for web analysis via Google Analytics. Using this addition, the IP address of the data subject's Internet connection is shortened and anonymized by Google if our website is accessed from a member state of the European Union or from another state party to the Agreement on the European Economic Area.
The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our website, and to provide other services related to the use of our website.
Google Analytics sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is able to analyze the use of our website. Each time you access one of the individual pages of this website, which is operated by the controller and into which a Google Analytics component has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical procedure, Google gains knowledge of personal data, such as the IP address of the data subject, which serves Google, among other things, to understand the origin of visitors and clicks.
The cookie is used to store personal information, such as the access time, the location from which access was made and the frequency of visits to our website by the data subject. Each time you visit our website, this personal data, including the IP address of the Internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass on the personal data collected via the technical process to third parties.
The person concerned can prevent the setting of cookies through our website, as already described above, at any time by means of a corresponding setting on the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the data subject. In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.
The data subject also has the possibility of objecting to a collection of data generated by Google Analytics relating to the use of this website as well as the processing of this data by Google and the chance to prevent such. To do this, the data subject must download and install a browser add-on under the link https://tools.google.com/dlpage/gaoptout. This browser add-on tells Google Analytics via JavaScript that no data or information about website visits may be transmitted to Google Analytics. Installing the browser add-on is viewed by Google as a contradiction. If the information technology system of the data subject is deleted, formatted or reinstalled at a later date, the data subject must reinstall the browser add-on in order to deactivate Google Analytics. If the browser add-on is uninstalled or deactivated by the data subject or another person within their sphere of control, it is possible to reinstall or reactivate the browser add-on.
Further information and Google's applicable data protection regulations can be found at https://www.google.de/intl/de/policies/privacy/ and at http://www.google.com/analytics/terms/de.html. Google Analytics is explained in more detail at this link https://www.google.com/intl/de_de/analytics/.
14. Data protection regulations on the application and use of Google AdWords
The person responsible for processing has integrated Google AdWords on this website. Google AdWords is an Internet advertising service that allows advertisers to place ads in both Google's search engine results and the Google advertising network. Google AdWords allows an advertiser to define specific keywords in advance, using which an ad will only be displayed in Google's search engine results if the user uses the search engine to retrieve a keyword-relevant search result. In the Google advertising network, the advertisements are distributed on relevant websites using an automatic algorithm and taking into account the previously defined keywords.
The operating company for the Google AdWords services is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of Google AdWords is to promote our website by displaying interest-relevant advertising on the websites of third-party companies and in the search engine results of the Google search engine and to display third-party advertising on our website.
If a data subject reaches our website via a Google ad, Google will store a so-called conversion cookie on the data subject's information technology system. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the person concerned. If the cookie has not yet expired, the conversion cookie is used to track whether certain sub-pages, such as the shopping cart from an online shop system, were accessed on our website. The conversion cookie allows both us and Google to understand whether a data subject who reached our website via an AdWords ad generated sales, i.e. completed or canceled a purchase of goods.
The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. We in turn use these visit statistics to determine the total number of users who were referred to us via AdWords ads, i.e. to determine the success or failure of the respective AdWords ad and to optimize our AdWords ads for the future. Neither our company nor other Google AdWords advertising customers receive information from Google that could be used to identify the data subject.
The conversion cookie is used to store personal information, such as the websites visited by the data subject. Each time you visit our website, personal data, including the IP address of the Internet connection used by the data subject, is transmitted to Google in the United States of America.
Such a setting of the Internet browser used would also prevent Google from setting a conversion cookie on the information technology system of the data subject. In addition, a cookie already set by Google AdWords can be deleted at any time via the Internet browser or other software programs.
The data subject also has the option of objecting to interest-based advertising by Google. To do this, the data subject must access the link www.google.de/settings/ads from each of the Internet browsers they use and make the desired settings there.
Further information and Google's applicable data protection regulations can be found at https://www.google.de/intl/de/policies/privacy/.
15. Data protection regulations on the application and use of Instagram
The person responsible for processing has integrated components of the Instagram service on this website. Instagram is a service that qualifies as an audiovisual platform and allows users to share photos and videos and also disseminate such data on other social networks.
The operating company for the Instagram services is Instagram LLC, 1 Hacker Way, Building 14 First Floor, Menlo Park, CA, USA.
Each time one of the individual pages of this website is accessed, which is operated by the controller and on which an Instagram component (Insta button) has been integrated, the Internet browser on the data subject's information technology system is automatically prompted by the respective Instagram component to download a display of the corresponding Instagram component. As part of this technical process, Instagram gains knowledge of which specific subpage of our website is visited by the data subject.
If the data subject is logged in to Instagram at the same time, Instagram recognizes which specific subpage the data subject visits each time the data subject visits our website and for the entire duration of their stay on our website. This information is collected by the Instagram component and assigned by Instagram to the respective Instagram account of the data subject. If the data subject clicks on one of the Instagram buttons integrated on our website, the data and information transmitted will be assigned to the data subject's personal Instagram user account and stored and processed by Instagram.
Instagram always receives information via the Instagram component that the data subject has visited our website if the data subject is logged in to Instagram at the same time as accessing our website; This takes place regardless of whether the data subject clicks on the Instagram component or not. If the person concerned does not want this information to be transmitted to Instagram, they can prevent the transmission by logging out of their Instagram account before accessing our website.
Further information and Instagram's applicable data protection regulations can be found at https://help.instagram.com/155833707900388 and https://www.instagram.com/about/legal/privacy/.
16. Data protection regulations on the application and use of LinkedIn
The person responsible for processing has integrated components of LinkedIn Corporation on this website. LinkedIn is an Internet-based social network that enables users to connect with existing business contacts and make new business contacts.
The operating company of LinkedIn is LinkedIn Corporation, 2029 Stierlin Court Mountain View, CA 94043, USA. LinkedIn Ireland, Privacy Policy Issues, Wilton Plaza, Wilton Place, Dublin 2, Ireland, is responsible for data protection matters outside the USA.
Each time our website is accessed, which is equipped with a LinkedIn component (LinkedIn plug-in), this component causes the browser used by the data subject to download a corresponding representation of the LinkedIn component. Further information about the LinkedIn plug-ins can be found at https://developer.linkedin.com/plugins. As part of this technical process, LinkedIn gains knowledge of which specific subpage of our website is visited by the data subject.
If the data subject is logged in to LinkedIn at the same time, LinkedIn recognizes which specific subpage of our website the data subject visits each time the data subject visits our website and for the entire duration of their stay on our website. This information is collected by the LinkedIn component and assigned by LinkedIn to the respective LinkedIn account of the data subject. If the data subject clicks on a LinkedIn button integrated on our website, LinkedIn assigns this information to the data subject's personal LinkedIn user account and stores this personal data.
LinkedIn always receives information via the LinkedIn component that the data subject has visited our website if the data subject is logged in to LinkedIn at the same time as accessing our website; This occurs regardless of whether the data subject clicks on the LinkedIn component or not. If the data subject does not want this information to be transmitted to LinkedIn, they can prevent the transmission by logging out of their LinkedIn account before accessing our website.
LinkedIn offers the option to unsubscribe from email messages, SMS messages and targeted ads and to manage ad settings at https://www.linkedin.com/psettings/guest-controls. LinkedIn also uses partners such as Quantcast, Google Analytics, BlueKai, DoubleClick, Nielsen, Comscore, Eloqua and Lotame, who can set cookies. 20. Legal basis for processing
Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as to fulfill tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance details or other vital information would then have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the above-mentioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. In this respect, he was of the opinion that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).
21. Legitimate interests in processing pursued by the controller or a third party
If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is to carry out our business activities for the benefit of the well-being of all our employees and our shareholders.
22. Duration for which the personal data will be stored
The criterion for the duration of storage of personal data is the respective statutory retention period. After the deadline has expired, the relevant data will be routinely deleted unless it is no longer required to fulfill the contract or initiate a contract.
23. Legal or contractual requirements for providing personal data; necessity for entering into a contract; obligation of the data subject to provide the personal data; possible consequences of not providing the data
We would like to inform you that the provision of personal data is sometimes required by law (e.g., tax regulations) or may also arise from contractual provisions (e.g., information about the contracting party). In some cases, it may be necessary for a data subject to provide us with personal data that we subsequently need to process in order to conclude a contract. For example, the data subject is obligated to provide us with personal data if our company enters into a contract with them. Failure to provide personal data would mean that the contract with the data subject could not be concluded. Before providing personal data, the data subject must contact one of our employees. Our employee will explain to the data subject, on a case-by-case basis, whether the provision of personal data is required by law or contract, or necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what the consequences of not providing the personal data would be.
